Puasa Tirakat Ngebleng (Wishal) dalam Perspektif Maqashid Al-Syaria‘h

Abstract

The tradition of fasting ngebleng, which has been passed down from generation to generation, is still sustainable today. However, the ngebleng fasting activity has many problems, some accept and rejects the implementation of fasting from various aspects. This study uses a descriptive qualitative research approach, with a case study research method at the Al-Hikmah Ansori Umar College of Science. There are two types of wishal, namely those which are permitted based on the hadith and fatwa of the scholars, and wishal whose law is debatable. According to the fuqoha' perspective, al-Qurtubi argued according to the jumhur ulama' that they said it was makruh in terms of the implementation of wishal, but according to Syafi'iyah as quoted from Imam al-Nawawi's opinion the implementation of wishal was makruh tahrim. Result that what was done by the beggars at the Al-Hikmah Ansori Umar Islamic College was a type of permitted wishal, because it was not included in the prevented wishal category. According to Syatibi's perspective, in maqashid syari'ah, based on the intent and purpose of the actor in carrying out wishal, it is included in the five main categories of maqashid syari'ah and is dharuriyat in nature.
