The phenomenon of Indonesia’s high smoking rate remains an irony amid the massive anti-smoking campaigns warning about the dangers of conventional cigarettes, which has led to the emergence of herbal cigarettes as an alternative claimed to be safer due to their use of natural spices and traditional fermentation. This study aims to analyze the practice of consuming Assikha herbal cigarettes in Tremas Village, Arjosari District, Pacitan Regency, and to examine their potential benefits and risks through the perspective of maqasid al-syari‘ah, which emphasizes the protection of religion, life, intellect, lineage, and wealth. This research employed a qualitative method with a case study approach through direct field observation, in-depth interviews with users, documentation, and literature review. The findings show that some community members believe that Assikha herbal cigarettes help reduce stress, ease breathing, and boost stamina, making them perceived as a better alternative than conventional tobacco cigarettes. However, laboratory tests reveal that herbal cigarettes still produce tar, nicotine, carbon monoxide (CO), and fine particles (PM2.5), although at lower levels, thus posing potential health risks if consumed regularly. From the maqasid al-syari‘ah framework, the legal status of herbal cigarettes, which is basically permissible (mubah), may change to reprehensible (makruh) or even prohibited (haram) if they are proven to cause greater harm than benefit. Therefore, this study recommends the need for further comprehensive research, strict regulation, and public education to prevent communities from relying on unproven health claims lacking valid scientific evidence.
